Terms of Service

These Terms of Service ("Terms") govern your access to and use of D-Proxy ("D-Proxy", "the Bot", "the Service", "we", "us", or "our"), operated by Eirborn Studios ("Eirborn").

By adding, accessing, configuring, or using D-Proxy, you agree to these Terms and to our Privacy Policy. If you do not agree to these Terms, you must stop using D-Proxy.

These Terms apply together with any additional terms clearly presented for particular D-Proxy features. They do not replace the terms, policies, or requirements of Discord or other third-party services.

If there is a conflict between these Terms and a mandatory requirement of applicable law, that mandatory requirement will prevail.

1. Discord and Third-Party Platform Terms

D-Proxy is not owned, operated, sponsored, endorsed by, or affiliated with Discord Inc.

D-Proxy is an independent third-party application. D-Proxy is not affiliated with, endorsed by, sponsored by, or operated by PluralKit or any other proxy bot. References to similar services are for descriptive purposes only.

Your use of D-Proxy remains subject to Discord's applicable Terms of Service, Community Guidelines, Developer Terms of Service, Developer Policy, and other applicable Discord policies.

D-Proxy does not authorize, encourage, or permit users to violate Discord's rules.

Discord may independently suspend, restrict, remove, or otherwise take action against accounts, servers, applications, or content. Eirborn has no control over Discord's independent enforcement decisions.

Changes to Discord's APIs, permissions, policies, infrastructure, or features may cause D-Proxy functionality to change, become limited, or stop working.

2. Eligibility

You may use D-Proxy only if you are legally permitted to use Discord and the Service in your jurisdiction.

You must satisfy Discord's applicable minimum-age requirements and any higher minimum age or consent requirements imposed by applicable law.

If you use D-Proxy on behalf of a server, organization, or other entity, you represent that you have authority to do so.

2.1. Definitions

• "Character" or "Proxy Profile" means a configured identity that a user creates or manages through D-Proxy to send, display, or transform messages through Discord, including associated names, descriptions, avatars, banners, pronouns, tags, and other profile information.

• "Character Slot" means the permitted number of active Characters or Proxy Profiles available under a user's or server's plan.

• "Plan" means the free or paid service tier that determines available features, limits, Character Slots, storage, and other entitlements.

• "Subscription" means a recurring paid Plan that renews automatically until cancelled.

• "Payment Processor" means a third-party service used to process payments, subscriptions, and billing-related information.

3. The D-Proxy Service

D-Proxy provides tools that may allow users and communities to create, manage, transform, transmit, or display proxy-related information through Discord. It is a proxy-based communication tool similar in purpose to other proxy bots, but it is independently operated by Eirborn.

Depending on the features available at a given time, the Service may include:

• proxy profiles ("Characters") and display configurations, including Character Slots;

• names, descriptions, avatars, banners, pronouns, tags, and other profile information;

• message and attachment proxying;

• imports and exports;

• server-specific configuration;

• free and paid Plans with differing Character Slot limits and features;

• APIs and integrations;

• accessibility-related accommodations; and

• other tools intended to support proxy-based communication and community functionality.

Character Slots, Plan features, and limits are service entitlements, not property. They may be changed, restricted, suspended, or discontinued as described in these Terms.

4. Permissions and User-Initiated Actions

D-Proxy will generally perform actions in response to commands, configuration, permissions, or other interactions initiated or authorized by a user or server.

You are responsible for understanding the permissions you grant to D-Proxy and for using the configuration and authorization mechanisms made available by Discord and D-Proxy.

D-Proxy does not grant itself permission to bypass Discord's permission model, privacy controls, blocks, bans, or other platform restrictions.

You may remove D-Proxy from a server or otherwise discontinue your use of the Service through the mechanisms made available by Discord and D-Proxy.

5. User Content

You may submit, upload, import, configure, or otherwise provide information and materials through D-Proxy ("User Content").

Depending on the features you use, User Content may include:

• character profiles, proxy tags, pronouns, descriptions, and related metadata;

• character slot configurations and plan-related preferences;

• avatars, banners, and other media;

• URLs and external resources;

• messages and attachments;

• configuration information; and

• other material that you intentionally provide to the Service.

5.1. Your Responsibility for User Content

You remain responsible for the User Content you submit or cause D-Proxy to process.

You represent that you have the rights, permissions, licenses, or other lawful basis necessary to submit and use that User Content through D-Proxy.

You are responsible for ensuring that your use of User Content does not knowingly:

• violate applicable law;

• infringe another person's intellectual-property rights;

• violate privacy or publicity rights;

• violate Discord's rules;

• facilitate fraud or abuse; or

• otherwise violate these Terms.

D-Proxy does not automatically determine who owns User Content, and the presence of material within D-Proxy does not mean that Eirborn claims ownership of it.

5.2. No Transfer of Ownership

You retain ownership of your User Content, subject to any rights belonging to third parties.

Nothing in these Terms transfers ownership of your User Content to Eirborn.

5.3. Plan Entitlements Are Not User Content

Character Slots, Plan benefits, and other service entitlements are not User Content and are not owned by users. They may be modified, limited, suspended, or removed according to these Terms, the applicable Plan, or legal, security, or operational requirements.

6. License to Process User Content

To provide D-Proxy, you grant Eirborn a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, process, display, and technically modify your User Content to the extent reasonably necessary to:

• provide requested D-Proxy functionality;

• deliver and display content through Discord;

• operate and maintain the Service;

• synchronize or transform content as part of an expressly requested feature;

• secure the Service;

• prevent abuse and fraud;

• troubleshoot errors;

• create or maintain backups where reasonably necessary; and

• comply with applicable legal obligations.

This license does not give Eirborn a general right to sell, publish, or commercially exploit your User Content merely because you use D-Proxy.

The license ends when the relevant User Content is deleted from the Service, except to the extent continued processing or retention is reasonably necessary for legal compliance, security, abuse prevention, backups, dispute resolution, or other purposes permitted by the Privacy Policy and applicable law.

7. Credentials, Tokens, and Authentication Secrets

You must not provide D-Proxy with Discord passwords, user login credentials, account-access tokens, session cookies, or other authentication secrets.

D-Proxy must not be used to obtain, collect, store, distribute, or process another person's authentication credentials without lawful authorization.

Any feature or import mechanism that does not explicitly and officially support a credential must not be used to submit one.

Attempts to use D-Proxy to obtain unauthorized account access may result in immediate suspension or termination and may be reported where appropriate.

Discord's developer policies prohibit applications from soliciting or deceiving users into providing passwords or other credentials.

8. Fair Use and Service Limits

D-Proxy may impose reasonable technical and operational limits on features including:

• character slots and proxy profiles;

• storage;

• imports and exports;

• requests;

• messages;

• attachments;

• API usage;

• rate of operations; and

• other resource consumption.

Limits may vary by user, server, feature, free or paid Plan, Subscription tier, or operational conditions. Paid Plans may increase Character Slots and other limits.

You may not intentionally circumvent limits through duplicate data, automated abuse, excessive imports, naming variations, multiple accounts, multiple servers, unauthorized automation, or other technical means, including attempting to obtain additional Character Slots or paid Plan benefits without paying for them.

8.1. Paid Plans, Billing, and Subscriptions

D-Proxy may offer optional monthly paid Plans that increase Character Slots and other limits.

8.1.1. Free and Paid Plans

We may offer a free tier and one or more paid tiers. Features, Character Slots, storage, and other limits may vary by Plan. We may modify, add, or discontinue Plans where reasonably necessary for technical, security, legal, operational, or business reasons.

8.1.2. Billing and Auto-Renewal

Paid Plans are billed in advance on a recurring monthly basis unless stated otherwise. By purchasing a paid Plan, you authorize us and our Payment Processor to charge your selected payment method on each renewal date. Paid Plans automatically renew until cancelled.

8.1.3. Cancellation

You may cancel a paid Plan through the mechanisms we provide or through the applicable Payment Processor. Cancellation stops future renewals but does not automatically refund the current billing period. Unless terminated earlier for breach, access to paid features continues until the end of the paid period.

8.1.4. Refunds

Except where mandatory applicable law requires otherwise, payments are non-refundable. We may, at our discretion, issue refunds or credits for accidental charges, service failures, or other reasonable circumstances. Nothing in this section limits any non-waivable consumer right.

8.1.5. Price Changes

We may change Plan prices. We will provide reasonable advance notice where required by law or where practical. Price changes apply after the notice period and do not affect the current paid period unless required by law.

8.1.6. Upgrades and Downgrades

Upgrades may take effect immediately or at the next billing cycle. Downgrades take effect at the next billing cycle unless stated otherwise. Downgrading may reduce Character Slots and features, and may require you to remove, deactivate, or export Characters above the new limit.

8.1.7. Non-Payment

If payment fails, we may retry the payment, suspend paid features, downgrade you to the free Plan, restrict related functionality, or terminate the paid Subscription. We may take these actions to the extent permitted by law.

8.1.8. Taxes

Prices may exclude applicable taxes, VAT, or similar charges. You are responsible for such charges unless we are legally required to collect them.

8.1.9. Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute without first contacting support, we may suspend or terminate your access while the dispute is investigated, to the extent permitted by law.

8.1.10. Trials

We may offer trials. Trial eligibility, duration, and conversion to paid Plans will be disclosed at sign-up. Unless stated otherwise, trials convert to paid Plans unless cancelled before the trial ends.

8.1.11. Entitlements

Character Slots, limits, and other Plan benefits are service entitlements, not property. They may be modified, suspended, or discontinued as described in these Terms.

9. Acceptable Use

You agree not to use D-Proxy to:

• violate applicable laws or regulations;

• violate Discord's Terms of Service, Community Guidelines, Developer Terms, Developer Policy, or other applicable Discord policies;

• obtain unauthorized access to accounts, systems, networks, or data;

• distribute malware, ransomware, credential theft tools, or other malicious software;

• conduct phishing, fraud, scams, or other deceptive activity;

• harass, threaten, stalk, intimidate, or doxx another person;

• impersonate a real person for fraud, deception, harassment, or other unlawful or harmful purposes;

• evade or facilitate evasion of bans, moderation actions, security controls, or access restrictions;

• bypass Discord's privacy, safety, security, permission, or access-control systems;

• scrape, harvest, enumerate, or collect Discord data beyond what is reasonably necessary for D-Proxy's stated functionality;

• use D-Proxy to facilitate unauthorized surveillance of another person;

• distribute or facilitate the distribution of non-consensual intimate imagery;

• distribute or facilitate child sexual abuse or exploitation material;

• facilitate exploitation, trafficking, or abuse of minors;

• use D-Proxy to organize or facilitate violent criminal conduct or other serious unlawful activity;

• deliberately interfere with the security, availability, or integrity of D-Proxy or its infrastructure;

• exploit security vulnerabilities except where expressly authorized by Eirborn or otherwise permitted by applicable law;

• use the Service to distribute content that is illegal in the applicable jurisdiction;

• circumvent or attempt to circumvent Plan limits, Character Slot limits, billing, or payment obligations;

• resell, sublicense, share, or transfer paid Plan benefits except as expressly permitted by Eirborn;

• use multiple accounts, servers, or other means to obtain additional free or paid entitlements without authorization; or

• otherwise materially abuse the Service in a manner that creates a significant risk of harm to users, Eirborn, Discord, or third parties.

Nothing in these Terms prohibits legitimate use of pseudonyms, fictional characters, roleplay, accessibility tools, or other lawful forms of identity representation that do not constitute deceptive or unlawful impersonation.

10. Misuse by Users and Third-Party Conduct

D-Proxy is a technical service that can be used by its users in ways that Eirborn does not control or authorize.

A user's misuse of D-Proxy does not mean that Eirborn authorized, directed, endorsed, or participated in that misuse.

Users are individually responsible for their actions and for content they submit, transmit, or cause the Service to process.

Eirborn does not guarantee that every User Content item or every use of the Service will be reviewed before it is processed.

Except where liability cannot lawfully be excluded, Eirborn is not responsible for unlawful, abusive, fraudulent, malicious, or otherwise unauthorized acts committed independently by users or third parties.

However, Eirborn may take reasonable measures when it becomes aware of suspected abuse, including investigation, restriction, deletion, suspension, termination, preservation of relevant information, and reporting or cooperation where required or permitted.

This section does not limit Eirborn's responsibility for its own conduct where such responsibility cannot lawfully be excluded.

11. Safety, Reports, and Enforcement

We may investigate suspected violations of these Terms, Discord's applicable rules, or applicable law when reasonably necessary to protect users, the Service, or third parties.

Depending on the circumstances, Eirborn may:

• issue a warning;

• reject or remove User Content;

• reject or disable an import;

• apply rate limits or cooldowns;

• restrict a feature;

• restrict use within a particular server;

• temporarily suspend access;

• permanently terminate access;

• block specific abusive activity;

• preserve information where appropriate;

• cooperate with Discord; or

• make reports to appropriate authorities where appropriate.

We may take immediate action without prior notice when reasonably necessary to address:

• an imminent security threat;

• suspected account compromise;

• serious abuse;

• threats of physical harm;

• child-safety concerns;

• malicious software or credential theft;

• significant fraud;

• a legal obligation;

• a request or enforcement action from Discord; or

• another situation where advance notice would materially increase risk.

Where reasonably practical, we may provide an explanation for an enforcement action and an appropriate method for contacting support about it.

We may withhold information about an investigation or enforcement action where doing so is reasonably necessary to protect another person, preserve evidence, prevent circumvention, maintain security, or comply with law.

12. Cooperation With Law Enforcement and Legal Authorities

Eirborn may receive requests from law-enforcement agencies, courts, regulators, emergency-response authorities, Discord, or other authorized entities.

Where required by applicable law or valid legal process, Eirborn will comply with such requests.

Where permitted by applicable law, Eirborn may also voluntarily cooperate with competent authorities when reasonably necessary to address serious threats to life, physical safety, cybersecurity, or other serious unlawful activity.

Depending on the circumstances, this cooperation may include:

• responding to legally valid requests;

• preserving relevant information where lawfully requested or reasonably necessary;

• providing information that Eirborn is legally permitted or required to disclose;

• assisting with abuse or security investigations; and

• taking action against accounts, servers, content, or activity associated with serious violations.

Eirborn does not guarantee that every report will result in disclosure of information or enforcement action. Legal requests must satisfy applicable requirements, and Eirborn will disclose only information it is legally permitted or required to disclose.

Where lawful and reasonably appropriate, Eirborn may notify affected users about legal requests. We may not provide such notice where prohibited by law, required to maintain confidentiality, or reasonably likely to interfere with an investigation.

13. Data Preservation

In connection with security incidents, abuse investigations, disputes, or legal obligations, Eirborn may temporarily preserve information that would otherwise be scheduled for deletion where such preservation is reasonably necessary and legally permitted.

Preservation does not necessarily mean that the information will be disclosed.

Once preservation is no longer reasonably necessary and no legal retention requirement applies, the information will be handled according to the Privacy Policy and applicable retention practices.

14. Privacy and Personal Data

Your use of D-Proxy is also governed by our Privacy Policy.

The Privacy Policy explains what information D-Proxy processes, how information is collected or received, why it is processed, where it may be stored or processed, when it may be shared, how long it may be retained, and how users can exercise applicable privacy rights.

D-Proxy may process information received from Discord and information that users intentionally provide to D-Proxy.

Depending on the functionality being used, this may include identifiers, usernames, server information, proxy configuration, message-related data, attachments, URLs, technical information, security information and billing-related information, such as Plan tier, Subscription status, transaction identifiers, renewal dates, and limited payment metadata.

D-Proxy will use Discord API data only for purposes permitted by Discord's applicable policies, the Privacy Policy, these Terms, and applicable law.

Discord's developer requirements include maintaining an accurate privacy policy, providing a mechanism for users to request deletion or modification of applicable data, limiting API-data use to permitted functionality, and applying reasonable security measures.

15. Data Retention and Deletion

Eirborn does not intend to retain personal data longer than reasonably necessary for the purposes described in the Privacy Policy, subject to applicable legal, security, operational, and abuse-prevention requirements.

Where applicable, users may request deletion or modification of their personal information through the process described in the Privacy Policy.

Some information may continue to exist temporarily in:

• backups;

• security logs;

• abuse-prevention systems;

• legal records;

• billing, transaction, and Subscription records that may be retained as required by tax, accounting, fraud-prevention, and legal obligations, even after a Plan is cancelled or an account is deleted; or

• other systems where immediate deletion is technically impractical or where retention is legally permitted or required.

Such information will remain subject to applicable security and access controls and will be deleted or otherwise handled according to the applicable retention policy.

Discord's Developer Terms require deletion of applicable API Data in specified circumstances, including when it is no longer necessary for approved functionality, when the application stops operating, when Discord or the applicable user requests deletion, or when required by applicable law.

16. International Processing

D-Proxy may use infrastructure, hosting providers, databases, content-delivery systems, monitoring services, or other service providers located in countries other than your own.

As a result, information processed through D-Proxy may be transferred to, stored in, or accessed from different jurisdictions.

Our Privacy Policy describes applicable international processing and safeguards.

To the extent required by applicable law, Eirborn will use legally available mechanisms and safeguards for international transfers of personal data.

Colombian Law 1581 establishes rules concerning international transfers of personal data and provides specific exceptions and requirements for transfers to jurisdictions that do not provide an adequate level of protection.

17. Security

Eirborn uses reasonable technical and organizational measures intended to protect information processed by D-Proxy against unauthorized access, loss, alteration, disclosure, or destruction.

No internet service, software system, or storage mechanism can be guaranteed to be completely secure.

Users are responsible for maintaining the security of their own accounts, devices, credentials, and permissions.

If you discover a security vulnerability in D-Proxy, you should report it through an official Eirborn security or support channel rather than exploiting the vulnerability or accessing information belonging to other users.

Where required by applicable law or Discord's applicable developer requirements, Eirborn will investigate and respond to security incidents and provide legally required notifications. Discord's Developer Terms also require developers to address incidents involving unauthorized access to API Data and to cooperate with Discord regarding remediation.

18. Third-Party Services and External Content

D-Proxy may depend on or interact with third-party services, including Discord, hosting providers, databases, content delivery services, APIs, and externally hosted URLs.

Eirborn does not control third-party services and, to the extent permitted by applicable law, does not guarantee or assume responsibility for:

• their availability;

• their independent policies;

• their security practices;

• their content;

• their enforcement decisions;

• changes they make to their services; or

• failures outside Eirborn's reasonable control.

Third-party content processed through D-Proxy remains subject to the rights and terms applicable to that content.

D-Proxy may reject or stop processing external resources that create security, legal, abuse, or operational concerns.

18.1. Third-Party Image References

Certain D-Proxy features provide built-in character or media references using a catalogue of names and external image URLs. For example, a user may select a fictional character by name, and D-Proxy may use the URL associated with that entry as the avatar for a proxied message.

For this built-in reference catalogue, D-Proxy stores reference data, such as a character name and its associated URL, in a catalogue mapping (for example, JSON). D-Proxy does not download, locally host, or store copies of the referenced image files as part of that catalogue, and it does not itself render those external images. Instead, D-Proxy passes the selected URL to Discord as the webhook avatar URL. Discord and its clients handle retrieval, caching where applicable, and display of the image, subject to their own systems and policies.

This description is limited to the built-in reference catalogue. Other D-Proxy features may process User Content, including user-provided images, attachments, avatars, banners, or other media, as described elsewhere in these Terms and the Privacy Policy.

The inclusion of a name or image URL in a catalogue does not mean that Eirborn owns the referenced image, has independently verified all rights associated with it, or grants a licence to use it beyond any rights provided by the relevant rights holder or applicable law. Public accessibility, API availability, or the existence of an image URL does not by itself establish that the image is in the public domain or licensed for every use.

19. Intellectual Property

D-Proxy and its original software, source code, architecture, documentation, branding, logos, website content, and other materials created by Eirborn are protected by applicable intellectual-property laws.

Except where a separate license expressly states otherwise, D-Proxy's original materials are proprietary to Eirborn and are not licensed to users merely because they access or use the Service.

Nothing in these Terms grants you a right to:

• copy D-Proxy's proprietary source code;

• redistribute proprietary D-Proxy software;

• create derivative works from proprietary D-Proxy materials;

• use Eirborn trademarks or branding as your own; or

• imply that a third-party deployment is officially operated or endorsed by Eirborn.

D-Proxy may include third-party software distributed under separate open-source or other licenses. Those licenses continue to govern the applicable third-party components.

20. Third-Party Intellectual Property

D-Proxy may display or process third-party names, characters, artwork, emoji, media, trademarks, or other intellectual property.

Eirborn does not claim ownership of third-party intellectual property merely because D-Proxy processes, stores, transmits, references, or displays it.

Users remain responsible for ensuring that their use of third-party material through D-Proxy is authorized under applicable law.

Nothing in these Terms grants users a license to third-party intellectual property merely because that material is available through D-Proxy.

Some character and media references may be included to support identification, lookup, roleplay, or other user-requested functionality. Their inclusion is not an assertion of ownership, official affiliation, endorsement, or authorization by the relevant rights holders. Availability through D-Proxy does not itself establish that a particular use is licensed or otherwise permitted. Users and Eirborn remain subject to the rights and obligations applicable to their respective activities under these Terms and applicable law.

21. Third-Party Reference Catalogues, Sources, and Non-Affiliation

21.1. Purpose and Structure of the Catalogues

D-Proxy may provide built-in reference catalogues for fictional characters, creatures, trainers, monsters, and other entities, including Pokémon and Pokémon trainers, Digimon, Palworld Pals, Dungeons & Dragons monsters, and Warrior Cats characters. These catalogues support search, identification, roleplay, and user-requested profile customization.

A catalogue entry may contain a name, identifier, descriptive metadata, and an external image URL. The source supplying a data record, the service returning an API response, the website hosting an image, the creator of that image, and the legal owner of the underlying intellectual property may be different parties.

This section identifies the public APIs, datasets, repositories, and reference pages used or referenced by D-Proxy's built-in catalogues. It distinguishes configured data sources from supplementary franchise references and licensing information. It does not establish that every entry originates from every listed source or that a source providing data also owns or licenses every associated image.

Where an individual entry has an associated external image URL, that URL identifies the destination configured for that entry. The presence of a URL or the use of a public API does not, by itself, establish the ownership, licensing status, or permitted uses of the corresponding material.

D-Proxy uses Bulbagarden Archives category-listing URLs to locate Pokémon Masters trainer sprite assets. The configured listing URLs include the following category pagination requests:

1. Initial listing using fileuntil.

2. Listing beginning at Giovanni's Sygna Suit sprite.

3. Listing beginning at the Masked Royal EX sprite.

4. Listing beginning at Sycamore's Masters sprite. 

These URLs are used to navigate the category listings; they should not be interpreted as proof that Bulbagarden created or owns every image contained in them. Pokémon-related data, characters, designs, sprites, artwork, logos, and other franchise materials remain subject to the rights and applicable terms of their respective owners.

The listed Pokémon data and sprite repositories are separate from the trainer sprite category above. The actual external destination configured for a particular catalogue entry determines which image host is contacted for that entry.

The configured endpoint returns Digimon records and associated information, including image URLs. Such image URLs may point to files hosted by DAPI rather than to the original creator's or rights holder's website.

D-Proxy's use of the API does not mean that Eirborn created, owns, or has independently verified the licensing status of every record or image returned by it. Digimon-related names, characters, designs, artwork, trademarks, and franchise materials remain subject to the rights held by their respective owners.

Where a particular entry uses a different source from those listed above, its associated URL or applicable source-specific attribution or licence information may provide further provenance. However, neither the presence of a URL nor the accessibility of an image or data record proves that Eirborn has permission to reproduce, display, distribute, modify, or otherwise use that material for every purpose.

Eirborn may update this index as catalogue sources change or additional information becomes available. The omission of a source from this section does not imply endorsement, authorization, or public-domain status for any material.

21.4. No Affiliation, Sponsorship, or Endorsement

Unless expressly stated otherwise in a separate written agreement, Eirborn, D-Proxy, and their operators are independent of, and are not affiliated with, sponsored by, endorsed by, or officially associated with Discord, any third-party API provider, dataset author, database, wiki, image host, franchise owner, publisher, developer, author, artist, licensor, or other rights holder referenced by these catalogues.

Third-party product names, company names, franchise names, character names, trademarks, service marks, logos, and other identifying material are included for identification, compatibility, or descriptive purposes. Their inclusion does not imply an official relationship, approval, sponsorship, partnership, or authorization.

All ownership rights in third-party material remain with the applicable rights holders. Eirborn does not claim ownership of such material merely because a name, record, reference, or URL is included in a D-Proxy catalogue.

21.5. External Image URLs and No Grant of Rights

For the built-in reference catalogues described in Section 18.1, D-Proxy stores reference information, including names and associated external URLs, rather than maintaining independent copies of the referenced image files as catalogue assets. D-Proxy passes the selected URL to Discord as the webhook avatar URL, and Discord and its clients handle image retrieval and display.

This description concerns the catalogue's external image references and does not represent that every other D-Proxy feature operates without downloading, processing, transforming, or storing user-provided or other media where necessary for that separate feature.

Neither these Terms nor the inclusion of a third-party reference grants users or Eirborn any ownership interest, licence, permission, or other right in third-party artwork, characters, trademarks, or other protected material, except to the extent such rights are independently granted by the relevant rights holder or arise under applicable law.

Users are responsible for their own use of D-Proxy's features and must comply with applicable law and any licence terms governing the material they use. Some datasets, image hosts, and repositories may impose specific conditions, including attribution requirements or restrictions on modifying or redistributing particular assets. Where a relevant licence or source-specific condition applies, it must be considered independently of this source index.

Eirborn does not represent that every item in a reference catalogue is licensed for every purpose. Inclusion in a catalogue must not be interpreted as a guarantee of lawful use or as legal advice.

21.6. Complaints and Removal

Complaints may concern user-submitted content, an entry in a built-in reference catalogue, a source record, or an external image URL used by D-Proxy. Where a complaint identifies potentially infringing or unauthorized material, Eirborn may, as appropriate, remove or disable the relevant catalogue entry, stop using or linking to the affected URL, restrict the relevant feature, or take other reasonable action.

Eirborn may request information reasonably necessary to evaluate a complaint and may refer a complainant to the applicable external hosting provider or platform where appropriate. Any action will depend on the circumstances, the information available, applicable law, and relevant platform requirements.

See Section 22 for the rights-complaint procedure.

Nothing in this section excludes or limits any rights or remedies that cannot lawfully be excluded or waived under applicable law.

22. Intellectual Property and Rights Complaints

If you believe that content processed or displayed through D-Proxy infringes your copyright, trademark, privacy, publicity, or other legal rights, you may contact Eirborn through the official support or legal channel.

A rights complaint should provide sufficient information for Eirborn to understand:

• the material concerned;

• where it appears;

• the right you believe is affected;

• the basis of the complaint; and

• a reliable means of contacting you.

Eirborn may request additional information where reasonably necessary to evaluate a complaint.

Where appropriate, Eirborn may remove, restrict, disable, or otherwise address material in response to a valid complaint or legal obligation.

23. Server Administrators

Server administrators may configure, restrict, or remove D-Proxy from their servers.

Server administrators may also establish additional server-specific rules concerning use of D-Proxy, provided those rules do not require D-Proxy or its users to violate applicable law or Discord's policies.

D-Proxy is not responsible for moderation decisions independently made by server administrators.

Users are responsible for complying with the rules of the Discord servers in which they use D-Proxy.

24. Accessibility and Accommodations

Eirborn aims to make D-Proxy usable by people with differing accessibility requirements and circumstances.

Where reasonably feasible, we may provide accommodations such as increased proxy or member capacity or other changes intended to make the Service more usable.

Accommodation requests should not require users to disclose sensitive personal information unless that information is genuinely necessary for the request.

Accommodations are subject to technical, security, abuse-prevention, and operational limitations.

25. Availability and Service Changes

D-Proxy is provided on an "as is" and "as available" basis to the fullest extent permitted by law.

We do not guarantee that D-Proxy will:

• remain available continuously;

• operate without interruption;

• be completely free of bugs;

• remain compatible with every version of Discord;

• preserve every message, attachment, profile, or configuration indefinitely; or

• maintain every existing feature permanently.

Service interruptions may result from maintenance, infrastructure failures, third-party outages, Discord changes, security incidents, network problems, or circumstances outside our reasonable control.

26. Backups and Data Loss

Eirborn may maintain backups for operational, security, disaster-recovery, or other legitimate purposes.

Backups are not guaranteed to provide permanent preservation of User Content.

To the fullest extent permitted by law, Eirborn does not guarantee recovery of deleted, corrupted, lost, or unavailable User Content.

Users are responsible for maintaining independent copies of content they consider important where the relevant D-Proxy functionality allows them to do so.

27. Suspension and Termination

You may stop using D-Proxy at any time.

Eirborn may suspend, restrict, or terminate access to D-Proxy when reasonably necessary because of:

• a breach of these Terms;

• abuse of the Service;

• serious security concerns;

• fraud;

• unlawful activity;

• a violation of Discord's applicable policies;

• a legal or regulatory requirement;

• a request or enforcement action from Discord;

• threats to users or third parties; or

• discontinuation of the Service.

Enforcement may apply to a user, server, feature, import, configuration, or other portion of the Service depending on the circumstances.

Where practical, Eirborn may provide notice and an opportunity to contact support. Immediate action may be taken where advance notice would create additional risk or interfere with security, legal, or safety measures.

Termination of access does not require Eirborn to immediately erase information that it is legally required or legally permitted to retain.

28. Effect of Termination

After termination, you must stop using D-Proxy.

Provisions that by their nature should continue to apply after termination will remain effective, including provisions concerning:

• intellectual property;

• User Content rights already granted for lawful processing;

• disclaimers;

• limitation of liability;

• indemnification;

• dispute resolution; and

• legal compliance.

29. Disclaimer of Warranties

To the fullest extent permitted by applicable law, D-Proxy is provided without warranties other than warranties that cannot lawfully be excluded.

Eirborn does not warrant that:

• the Service will be uninterrupted;

• defects will always be corrected;

• content will never be lost;

• third-party services will remain available;

• D-Proxy will always behave exactly as intended in every environment; or

• the Service will satisfy every user's particular requirements.

Nothing in these Terms excludes a warranty, statutory protection, or legal right that cannot lawfully be excluded.

30. Limitation of Liability

To the fullest extent permitted by applicable law, Eirborn and its owners, contributors, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses of profits, revenue, goodwill, business opportunities, or data arising from or related to your use of D-Proxy.

To the fullest extent permitted by applicable law, Eirborn's total aggregate liability arising out of or relating to D-Proxy will not exceed the greater of:

• the amount you actually paid to Eirborn for D-Proxy during the twelve months preceding the event giving rise to the claim; or

• US$100 if you have not paid Eirborn for the Service.

This limitation does not apply to liability that cannot legally be excluded or limited.

31. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Eirborn and its owners, contributors, employees, contractors, and service providers against third-party claims, liabilities, damages, and reasonable costs arising directly from:

• your unlawful use of D-Proxy;

• your material violation of these Terms;

• your infringement of another person's rights; or

• User Content that you submitted or caused D-Proxy to process.

This section does not require you to indemnify Eirborn for losses caused by conduct for which such indemnification would be prohibited by applicable law.

32. Force Majeure

Eirborn will not be responsible for delay, interruption, or failure to perform caused by circumstances outside its reasonable control, including:

• internet or network failures;

• infrastructure outages;

• hosting-provider failures;

• Discord outages or changes;

• natural disasters;

• war or civil unrest;

• government actions;

• cybersecurity incidents;

• widespread software or hardware failures; or

• other events that Eirborn could not reasonably prevent or control.

This section does not eliminate obligations that applicable law requires Eirborn to perform despite such circumstances.

33. Changes to These Terms

We may revise these Terms from time to time.

The Last Updated date at the top of this page indicates when these Terms were most recently changed.

For material changes, we will make reasonable efforts to provide notice through an appropriate channel where practical.

Changes required for legal compliance, security, abuse prevention, Discord compliance, or urgent operational reasons may take effect immediately where reasonably necessary.

Your continued use of D-Proxy after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

34. Governing Law

These Terms are governed by the laws of the Republic of Colombia, without regard to conflict-of-law principles, except where mandatory applicable law requires otherwise.

Any dispute arising from or relating to these Terms will be subject to the competent courts of Colombia, except where applicable law gives a user a non-waivable right to bring a claim in another jurisdiction.

Nothing in this section is intended to remove mandatory consumer-protection, privacy, or other legal rights that apply to users under the laws that govern them.

35. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

36. No Waiver

A failure by Eirborn to enforce a provision of these Terms does not constitute a waiver of Eirborn's right to enforce that provision later.

Any waiver must be made explicitly by Eirborn.

37. Assignment

You may not transfer your rights or obligations under these Terms without Eirborn's prior written consent, except where such transfer is permitted by applicable law.

Eirborn may transfer or assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or transfer of the Service, subject to applicable law.

38. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly incorporated into them, constitute the agreement between you and Eirborn concerning your use of D-Proxy.

These Terms replace earlier versions of D-Proxy's Terms of Service concerning the same subject matter.
